Our Work as Testifiers

The recommended (i.e. least expensive) manner of entering counseling and/or parenting information into evidence for use in a court proceeding is by a party with legal right to medical records requesting such information to be shared with the Guardian Ad Litem (GAL). The GAL may then share copies of records, in addition to providing his/her expert testimony.

When the testimony of one of our providers is needed, a subpoena should be sent via certified mail to the provider's name, c/o Mares Cares Counseling, LLC, 263 Delano Ave., Chillicothe, OH 45601.

A special Release of Information for Fact or Expert Witness is required. In addition, a retainer of $750.00 per provider being subpoenaed as an expert witness is required (payable to Mares Cares Counseling, LLC). The release of information form AND expert witness retainer (if applicable) must be received at least five (5) business days prior to the deposition or hearing date to allow adequate time for the provider to block his/her schedule, review records and to prepare to testify. Payment in full for provider's time preparing and attending court as a fact witness at the provider's cash rate is required prior to resumption of counseling following the deposition or hearing date.

Ohio Administrative Code 4757-6-01
